Fees

Depending on the nature of the matter, fees are charged on a time basis or as a fixed fee. After an initial discussion to define the scope of the engagement, a fee agreement setting out that scope and the billing terms is signed before any work begins.

“Fees for representation, consultation, assistance, advice, drafting of private legal instruments and advocacy are set by agreement with the client. (…) Fees take into account, according to custom, the client’s financial situation, the difficulty of the matter, the costs incurred by the lawyer, their standing and the work carried out. Setting fees solely on the basis of the outcome of proceedings is prohibited. An agreement providing, in addition to remuneration for work performed, for an additional fee based on the result obtained or the service rendered is lawful.”

Article 10 of Act no. 71-1130 of 31 December 1971

Two billing methods

Hourly

Fees calculated on the basis of the time actually spent on the matter.

  • Hourly rate set out in the fee agreement
  • Detailed statement of work accompanying each invoice
  • Suited to matters whose duration and complexity cannot be determined in advance

Fixed fee

Fees set in advance, by mutual agreement between the lawyer and the client, for a specifically defined service.

  • Scope of work clearly defined in writing
  • Fixed, predictable fee, suited to matters whose course can be anticipated

The fee agreement

Every engagement is preceded by a fee agreement between the firm and the client, in order to define as precisely as possible the scope of the engagement and the applicable fee terms.
